What Is Alternative Dispute Resolution?

Most people are familiar with the concept of courtroom disputes, but the legal system has other options that are designed to keep you out of court, reduce the time spent arguing and save you money. These include:

  • Mediation: This resolution option brings both parties together with their attorneys as representatives to discuss their priorities, possible areas for compromise and solutions to their dispute. A third-party mediator will offer a suggested resolution, which the parties involved may choose to adopt.
  • Arbitration: Like mediation, both parties in a dispute come together in a neutral setting to examine the issues at hand. However, in this case, a third-party arbitrator will determine a “fair” resolution, which is legally binding and often precludes further legal action.
